Township OF WHITE OAK Resolution NO. 1

(ENACTED DECEMBER 9, 1996)

A RESOLUTION TO ADOPT AN ORDINANCE TO PROVIDE FOR COLLECTION OF FIRE AND AMBULANCE FEES

WHEREAS, the Township of White Oak has entered into contracts with the Township of Ingham, the Township of Leroy, and the Township of Stockbridge for Fire and Emergency Medical Services.

WHEREAS, the Township of White Oak is required to pay other Townships a fee under their respective contracts, for each hour or fraction thereof, for fire suppression services. Therefore, the Township of White Oak establishes the contractual fee as the rate for said services.

WHEREAS, the Township of White Oak is required to pay the Township of Ingham at least ONE HUNDRED DOLLARS ($100.00) per emergency medical service call, which response is made. Therefore, the Township of White Oak establishes the contractual fee as the rate for said service.

WHEREAS, the Township of White Oak has statutory authority to collect these fees from the person for whom the services are rendered, pursuant to MCL 41.806(a); MSA 5.2604(6a).

WHEREAS, the Township of White Oak has authority to adopt Ordinances for the regulation of public health, safety, and general welfare of persons and property, included but not limited, to fire protection and to provide penalties for the violation of those ordinances, pursuant to MCL 41.181; MSA 5.45(1).

WHEREAS, the Township of White Oak has authority to adopt a penalty for violation of its Ordinances, of a fine not to exceed $500.00 or by imprisonment in the county jail not to exceed 90 days, or both, pursuant to MCL 41.183; MSA 5.45(3).

WHEREAS, the Township of White Oak has determine that it is necessary for the public health, safety, and welfare of its residents to adopt an Ordinance for the collection of fees for fire suppression services and emergency medical services and to provide for penalties for those who violate that ordinance. In order that the Township of White Oak may continue to provide the services to township residents, by collecting and paying the contractual fees to the respective service providers.
